My friend is trying to get a deal on a new Passat, since she totaled her Camry earlier this month. She found a brand new 2013 model that's still on a local VW dealer's lot. It's got 36 miles on the clock. She should be able to get this for invoice if not well below, since it's a year old, the end of the month, and the 2015's will be coming in soon.
Of course, they are pulling all the stops and are trying to avoid letting this car go for invoice pricing. Little do they know she's being coached by me!
One of the things they were trying to pull really surprised me though. They were trying to get her to allow the manufacturer's warranty to be effective from June 2013. A YEAR gone because they haven't been able to move it off their own lot. Is this really weird and shady or is this common practice? I've never heard of it before and I wouldn't even think it would be legal.

Sounds like the warranty already started then.
Similar instance with my moms car a few years ago. 2011 in late 2012, only a couple hundred miles but the warranty already started. Had to be sold as used.

That means they probably reported it as sold last june. VW dealers are kinda always terrible, so that doesn't surprise me

this has only got 36 miles on it though! If they want to do that, she should be asking for used car pricing instead of invoice

so maybe they had a buyer for it, started the clock in the warranty, and then for some reason that buyer never took delivery?

From my knowledge, the manufacture's warranty starts on the date of original purchase. So unless it is/was a "Demo" car, which is generally dealer speak for "We rolled a car to someone, but we couldn't get the banks for finance said person, so they had to bring the car back" At that point it is a used car, and the original sale date would be the start of the warranty period.
If this is not the case, they are trying to pull a fast one, illegally I might add, and more than likely against the manufactures policy on factory warranty.

Nope, they probably "bought" it themselves, thus starting the warranty. Now they don't want to have to say to VW of America that they fudged it

I would ONLY buy it if the warranty is made effective from date of purchase. Because the original warranty has a bunch of stuff which includes :
Basic Warranty - 3 year / 36,000 miles
Free Maintenance - 3 year / 36,000 miles
Drivetrain - 5 year / 60,000 miles
Roadside - 3 year / 36,000 miles
Rust - 12 year / Unlimited miles

definitely. she's already told them she's not doing that. It's more the fact that they tried makes me suspicious. When my friend first refused taking a year off, they asked if she'd have it start from this past June, also weird.

Warranties start on the date first sold and not some arbitrary date the dealer decides. If the dealer is trying to pull that shit tell them that you want an extra $5,000 off the car. But really since it is last years model, has 36 miles on it and they are trying to pull some shady shit me thinks that there might be something worth investigating on that car. Maybe get the vin and call up another VW dealer or even VW its self to check on the warranty status and the date sold. If that comes back as a new car then tell them to pound sand. If it comes off as a sold car tell them that it wasn't offered as a "demo" and that you are only willing to pay used car pricing on it. It is really odd that the dealer is being silly about a '13 car when they have '14 cars to worry about getting off the lot before the '15's come in.
Tell her to go in with a rock solid price and a full warranty and to walk away if they don't agree to it or try to be shit bags again. But calling VW of America and requesting warranty status info on that car should clear the issue of whether or not the car has been sold or if it is indeed still a "new" car.
